Therefore, you fully accept the terms and conditions of purchase set forth for using this website and hiring or purchasing services offered.

ORDERING METHODS AND PRICE

All orders are subject to the condition / requirement of being placed in packs of at least 6 bottles and so successively 6 in 6. All orders that do not meet this requirement will be rejected.

Each client declares that they have full capacity to use credit cards and that they have sufficient funds to cover all costs resulting from the purchase of products through Celler Cercavins.

By pressing the "Pay" button during the purchase process, the member declares that he/she fully and unreservedly accepts all of these General Sales Conditions.

The data recorded by Celler Cercavins constitutes proof of the transactions made between Celler Cercavins and the members of its Private Community. Celler Cercavins will confirm your order by sending an email.

The contractual information is presented in Spanish and will be confirmed at the latest at the time of delivery.

The prices of our products include all taxes contemplated within the Customs Union of which Spain is a member, as stipulated in Article 4 of Regulation (EU) No. 952/2013 of the European Parliament and Council of 9 October 2013, establishing the Union's customs code. The taxes that are due as a result of the export of goods outside this space will be charged to the customer. Likewise, prices do not include transport costs.

Celler Cercavins reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the tariffs in force at the time of the registration of the orders (subject to the availability of the product), unless there is a manifest typographical error.

The products remain the property of the supplier until full payment of the price has been made.

Celler Cercavins reserves the right to refuse an order from any member with whom it has a dispute.

AVAILABILITY
Celler Cercavins will do its best to please all its customers in the demand of the products.

In case of unavailability of the product after the order has been placed, the customer will be informed by e-mail of the cancellation of the order.

Following this request, the speed of the return to the customer's bank account will depend on the type of bank card and the conditions of each bank. These deadlines are again specified in the "Delivery" clause.

PAYMENT
Payment by card:
The Regulation of the purchases is made by bank card. The bank cards accepted are: Visa, MasterCard, Visa Electron, American Express, Maestro, Diners and Red 6000 cards. The purchase price will be charged to the customer's bank account within 4 days of the order and will be considered effective after confirmation of your agreement by the bank payment centers.

In the event that the TPV (Point of Sale Terminal) informs of the refusal of the card, the order will be automatically cancelled, informing the client of this cancellation on-line.

Celler Cercavins offers to their customers two other payment methods, by PayPal and Bank Tranference.

SECURITY
For your security Celler Cercavins has trusted the system of payment by credit card to a payment gateway.

The bank details entered are encrypted and transmitted securely to the bank's servers and are subsequently verified with the issuing bank to prevent possible fraud and abuse.

This procedure of data introduction is guaranteed by the encryption technology SSL (Secure Socker Layer) -128 bits, one of the most advanced and efficient protection systems currently available, thanks to which, no third party will have access via Internet to this information regarding the banking data introduced by the client.

Only the Bank and PayPal have access to the banking data linked to these payment methods, so Celler Cercavins does not know or record these data during the payment operation.

DELIVERY
The supplier will send the products to the distribution warehouse, from where the products will be sent to the final destination established by the buyer. The buyer will receive an e-mail when the order has been picked up by the carrier.

The transport costs will be paid by the buyer.

The purchase order corresponding to the order will be available at Celler Cercavins, once the payment has been confirmed, which can be viewed via the link: "My Orders", as soon as the e-mail is sent. This original purchase order includes delivery charges and VAT.

Celler Cercavins will ask its customers to choose the place of delivery, specifying their home, office or centre where they want the product to be delivered. The delivery time can be consulted in NACEX website.

Celler Cercavins will inform the customer of the departure of the order from the distribution warehouse, by sending an e-mail.

Each delivery is considered to have been made as soon as the product is made available to the customer by the carrier, as evidenced by the control system used by the carrier. It is the responsibility of the recipient to check the order at the time of delivery and then to make all reservations and complaints that may appear justified, including the possibility of rejecting the package, if it has been opened or if it has obvious signs of damage.

RETURN

Celler Cercavins will not accept any type of return. Accepting the purchase conditions, the client accepts the following action:

I acknowledge that the acceptance of the contract involves the supply of a good made according to my specifications and, therefore, clearly personalized. Therefore, in accordance with the provisions of article 103 of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, The return of our food products is not applicable to this contract.

Thus, the right of return for breakage or other problem does not apply.

GUARANTEE
The guarantees and after-sales services will be governed by the Royal Legislative Decree 1/2007 of 16 November which approves the text of the General Law for the Defence of Consumers and Users. In accordance with this regulation, the seller is obliged to deliver to the consumer and user products that are in conformity with the contract, being liable to the latter for any lack of conformity. The consumer and user has the right to have the product repaired, replaced, the price reduced or the contract rescinded.

LIABILITY, LITIGATION AND APPLICABLE LAW
Celler Cercavins could not be held responsible for the breach of the contract concluded in case of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communications, flood or fire. In the event of a dispute, the member will contact Celler Cercavins as a matter of priority to obtain an amicable solution.

The Courts of Madrid are the only competent bodies. These general sales conditions shall be interpreted in the Spanish language and shall be governed by Spanish law. Any disagreement that may arise as a result of their validity, interpretation or execution shall be submitted to the Courts of Madrid, to which exclusive jurisdiction is expressly attributed.

MODIFICATION OF THE GENERAL CONDITIONS OF SALE
Celler Cercavins reserves the right to modify the general sales conditions without prior notice, and may change, delete or add both the contents and services provided through it and the way in which these appear to be presented or located on its servers.
